7. Aan de goedkeuring worden voorts de volgende voorwaarden verbonden:
1° De belanghebbende (belastingplichtige) stelt aan de controlerende ambtenaar
tijdens het onderzoek leesapparatuur (reader) ter beschikking, welke van een zodanige kwali
teit is dat daarmede een duidelijke weergave op het beeldscherm kan worden verkregen.
2° De door de controlerende ambtenaar gewenste beelden worden binnen aan
vaardbare tijd verkregen. Dit vereist een doelmatige organisatie van de archivering van micro
films.
3° Op verzoek van de controlerende ambtenaar worden van de door hem aangege
ven beelden kosteloos leesbare afdrukken (hard copies) gemaakt, zulks teneinde op verschil
lende bescheiden voorkomende gegevens gelijktijdig in leesbare vorm ter beschikking te heb
ben.
4° De microfilms worden gedurende tien jaren bewaard, met dien verstande dat de
ze termijn wordt verminderd met de periode gedurende welke de originele bescheiden, alvo
rens tot microverfilming is overgegaan, zijn bewaard.
8. In geval van uitbesteden van (onderdelen van) de microverfilmingsprocedure aan een service
bureau dient de volgende procedure te worden gevolgd. De inspecteur der directe belastingen
dan wel der vennootschapsbelasting, in wiens ambtsgebied de belanghebbende woont of ge
vestigd is, verzoekt de Rijksaccountantsdienst naar de door dat servicebureau te verrichten
werkzaamheden met betrekking tot de microverfilming een onderzoek in te stellen, waarbij
wordt nagegaan in hoeverre deze werkzaamheden in overeenstemming zijn met de onder 6 ver
melde voorwaarden. In geval het servicebureau niet in zijn ambtsgebied is gevestigd, wordt het
onderzoek ingesteld door tussenkomst van de inspecteur der directe belastingen of der ven
nootschapsbelasting in wiens ambtsgebied het servicebureau is gevestigd. Voor zoveel nodig
merk ik hierbij nog op dat het onderzoek in beginsel slechts éénmaal behoeft plaats te vinden
en dat slechts in bijzondere omstandigheden herhaling daarvan nodig is. De verantwoordelijk
heid voor gemaakte fouten bij het microfilmen en voor het niet volledig verfilmen van alle
daarvoor in aanmerking komende bescheiden blijft rusten bij de belanghebbende zelf.
9. Tenslotte vestig ik er nog nadrukkelijk de aandacht op dat de hiervoor bedoelde goedkeuring
om - wat betreft de belastingheffing - boeken en bescheiden na twee jaar door microfilms te
vervangen, de verplichting van artikel 6, derde lid, van het Wetboek van Koophandel alsmede
de op het niet nakomen daarvan in het Wetboek van Strafrecht gestelde sancties, onverlet laat.

Indien en voor zover vorengenoemde belastingplichtige maat is in de maatschap dan wel firmant
in een vennootschap onder firma of commanditaire vennootschap, omvat deze goedkeuring

tevens eenzelfde goedkeuring voor die vennootschap onder firma, maatschap of commanditaire
vennootschap.
Deze goedkeuring kan te allen tijde worden ingetrokken indien zulks naar het oordeel van de In
specteur gewenst is.
SUMMARY
Substitution of records by reproductions
A summary of Dutch law on evidence leads to the conclusion that a copy of a public re
cord made by the competent public authority has the same evidential value as the origi
nal. Reproductions of other records have also evidential value if a court can derive a le
gal presumption of authenticity from facts and circumstances outside the reproduction
itself.
Archival legislation considers as records/archives not only conventional records,
machine-readable records, audiovisual records, etc., but also photographic reproducti
ons which have legally been substituted for original documents. Such reproductions
are, for example, copies of damaged civil registration records made according to a spe
cial law, and reproductions of original public records which are listed in a schedule for
destruction. Substitution of records by reproductions is not allowed if the original re
cords are deemed for infinite preservation. Many public agencies however want to
gain space in their offices by destroying records after microfilming.
The author considers it possible in the case of public records to make an official copy
on microfilm or any other medium, whereafter the original documents could be
destroyed according to the normal procedure. In the case of non-official records a reli
able and well-controlled microfilm program could constitute the facts and circumstan
ces mentioned above, which would lead a court to the legal presumption of authenticity
of the reproduction. The author introduces the Swiss regulations on substitution of re
cords by reproductions and the Canadian standard on microfilm as documentary evi
dence, which both concentrate on the credibility of the microfilm program rather than
on technical details about the credibility of the images, as the French experimental stan
dard Z 43-061 does. The work of ISO/TC 171/WG 7 is mentioned.
In the Netherlands procedural guidelines for substitution of records by microfilms exist
in fiscal matters only. According to a circular letter of the Secretary of State for Finan
ce (published as annexe) business firms are authorized tot destroy their book keeping
after microfilming, provided there are written instructions which guarantee credibility
of the program. The instructions have to deal with the microfilm procedure, the storage
of the microfilm, and the destruction of the original documents. The circular enumera
tes the checkpoints of each of these three elements. According to the author the scope
of these fiscal regulations could be enlarged to form the basis of general regulations for
the substitution of records by reproductions.
