land Polder does not discharge the responsibilities referred to in Section 29, We may, having heard the Provincial Executive concerned, lay down that such portion of the body's records we shall designate be transferred to a. State repository, to be kept there at that body's expense at such rates as we shall determine and until such time as a new Order has been issued. Section 36. The terms 'Water Boards', 'Fenland Boards' and 'Fenland Polders' shall include the sub-divisions of such bodies as are administratively independent. CHAPTER VI Archives of other Public Bodies and Organs Section 37. 1 A joint agreement as referred to in the Joint Agreements Act shall include measures regarding the responsibility for and the keeping and custody of the records of such as have been set up under the terms of the joint agreement, And regarding their supervision. 2 Such measures shall be taken as far as possible in accordance with the provisions of the present Act. Section 38. 1 The Executive Committees or, in their absence, the Managing Com mittees of public bodies other than those referred to in the preceding Sections shall be responsible for the records of the organs of these bodies, with the exception of those transferred to a State repository. 2 The manner in which this responsibility shall be discharged shall be regulated by General Administrative Order. 3 The Keeper of the State Archives shall exercise supervision over the keeping of the records referred to in paragraph 1 in accordance with rules to be laid down by General Administrative Order. CHAPTER VII Penal Provision Section 39 1 Any person who fails to discharge the responsibility as laid down in the first sentence of Section 4 shall be liable to a fine not exceeding two thousand 2 Failure to discharge the responsibility referred to in the preceding paragraph shall constitute an offence. 3 If the offence is committed by or by authority of a juristic person, penal proceed ings shall be instituted against, and the fine imposed upon, the person on whose or ders the offence was committed or who was actually responsible for its commission. CHAPTER VIII Transitional and Final Provisions Section 40 The Royal Decree of 28 August 1919 (Staatsblad No. 547), as amended by the Royal Decree of 15 April 1929 (S.,ab,bl,<l No. 162) »d Jhe Ro,»l De» of 19 April 1929 (Staatsblad No. 171). of 31 May 1929 (Staatsblad No. 26» 6 July 1929 (Staatsblad No. 381) and of 24 November 1932 (Staatsblad No. 560) remain in force until their abrogation. Where appropriate, We shall, byGenerral ministrative Order, bring these Decrees into line with what has been provid y virtue of the present Act. [196] Section 41. Section 69a of the Act governing the Profession of Notary Public of 9 July 1842 (Staatsblad no. 20)1 shall be worded as follows: Section 5 of the Archives Act, 1962, shall not apply to notarial records. Our appropriate Ministers may arrange for such notarial records as are more than seventy-five years old to be transferred to State repositories. Section 42. In Section 14 of the Water Control and Public Works Act, 19002, the following words shall be inserted before the full stop at the end of paragraph 1'as also concerning their records'. Section 43. A new Section shall be inserted in the Public Assistance Act8, reading as follows: Section 20 octies 1 The Board shall be responsible for the records of the establishment. 2 The costs resulting from the discharge of the responsibilities referred to in para graph 1 shall be borne by the establishment. 3 The Provincial Executive shall exercise supervision over the discharge of the responsibilities referred to in paragraph 1 in accordance with rules to be laid down by General Administrative Order. 4 The costs resulting from the supervision referred to in paragraph 3 shall be borne by the province concerned. Section 44. 1 The Archives Act, 1918 (Staatsblad No. 378) is hereby abrogated. 2 This Act may be cited as the Archives Act, 1962. 3 It shall enter into force on a date to be determined by Us. We direct an ordain that these presents be published in the 'Staatsblad' and that all Ministerial Departments, Authorities, Bodies and Officials whom they may concern diligently implement them.
